CITY OF GRANDVILLE
REGULAR CITY COUNCIL MEETING
MONDAY, DECEMBER 13, 2010
The
Grandville City Council Regular Meeting of December 13, 2010 was
called to order by Mayor James Buck at 7:00 pm.
Present were Council Members Randal Gelderloos, Steve Kauffman,
Steve Maas, Joshua Meringa, Carole Pettijohn, Dick Richards, and
Mayor James Buck. Absent: None
Also
attending: Matt Butts, Assistant City Manager; Randy Kraker, City
Attorney; Kenneth Krombeen, City Manager; Mike May, Fire Lieutenant;
Mary Meines, City Clerk; Dennis Santo, Police Chief; Dan Steere,
Deputy Police Chief; Harvey Veldhouse, Fire Chief; and Lynnae White,
Fire Lieutenant.
Council Member Pettijohn gave the invocation; and was followed by
the Pledge of Allegiance.
Motion made by Council Member Maas, supported by Council Member
Richards, to approve the December 13, 2010 agenda as presented. The
motion was APPROVED.
Motion made by Council Member Meringa, supported by Council Member
Richards, to waive the reading of the minutes of the Regular Meeting
of November 22, 2010 and approve as presented. The motion was
APPROVED.
Motion made by Council Member Pettijohn, supported by Council Member
Gelderloos, that bills for Fiscal Year 2010-2011 totaling
$390,410.54 as presented by the City Manager, be allowed and
authorize the Treasurer to pay the same. The motion was unanimously
APPROVED by roll call vote.
PUBLIC COMMENT
Mike
Cobb, 3362 40th St., expressed thanks to Harvey Veldhouse
for his years as a City employee.
Russ
Ripma, 3965 Johnson Lane, extended an invitation to the Senior
Neighbors Family Fun Night on December 14, 2010 from 5:30 – 7:00 pm.
ORDINANCES AND RESOLUTIONS
1. City Manager Krombeen explained the recently passed
legislation re: Sunday morning sales of beer, wine and alcohol. The
legislation took effect on December 1 and would allow licensed
establishments the ability to apply for a permit to sell alcohol
between the hours of 7:00 am Sunday and 2:00 am Monday which would
be in conflict with the City ordinance allowing beer and wine sales
only after noon on Sundays. The current ordinance was approved by
the voters in 2006. A local government may opt out and not allow
any sales but the local government would have to take action by
December 15. If the City Council chooses to do nothing, the state
law will go in effect; or if a local government opts out would they
be opting out of selling any alcohol for the entire day. The LCC
has indicated they will honor any local prohibition on the sale of
alcohol. City Attorney Kraker indicated the intent of the
legislation was to allow for opting out of the morning sales but was
not written that way. The LCC is going to honor what was intended
by the legislation. He explained the resolutions before Council for
consideration. The City would be able to change their mind in the
future.
As a
result of City Council discussion, City Attorney Kraker was directed
to look at ordinance change request by a petition generated by the
voters or Council voluntarily making the change. In the past,
changes to the alcohol ordinance were made as a result of a vote of
the people.
Approval of Resolution No. 2939 will prohibit sales of any liquor on
Sundays. Motion made by Council Member Maas, supported by Council
Member Gelderloos, to approve Resolution No. 2939, continuing the
current ban on Sunday sales of liquor. The motion was APPROVED by a
6-1 roll call vote (Yeas: Gelderloos, Maas, Meringa, Pettijohn,
Richards and Mayor Buck. Nays: Kauffman)
Approval of Resolution No. 2940 will continue the sales of beer and
wine after noon and prohibits the morning sales. Motion made by
Council Maas, supported by Council Member Meringa, to approve
Resolution No. 2940, continuing current ban on Sunday sales of beer
and wine. The motion was APPROVED by a 6-1 roll call vote (Yeas:
Gelderloos, Maas, Meringa, Pettijohn, Richards and Mayor Buck.
Nays: Kauffman)
2. City Manager Krombeen explained that the ratified
agreement with the Grandville City Employees Association (DPW
workers) included an increase in both employee and employer
contribution to the existing defined contribution retirement and a
decrease in the employee contribution rate to the defined benefit
plan. MERS requires Council to pass a resolution with the new
contribution amounts. The standard resolution approving the new DB
contribution rates from 5.24% to 4.24% will make the change
effective January 1, 2011. Because the administration of the
defined contribution plan is changing over from ICMA to MERS there
currently is not an approved form to use for the DC changes. MERS
is recommending a motion be adopted reflecting the contribution
changes (employer contribution from 9% to 10% and employee
contribution from 3% to 4% effective 1/01/2011). Retroactive action
may need to take place once the new DC contribution forms are
approved.
Motion made by Council Member Richards, supported by Council Member
Meringa, to approve Resolution No. 2941, authorizing a change in the
Grandville City Employees Association defined benefit employee
contribution to 4.24% effective 1/01/2011. The motion was
unanimously APPROVED by roll call vote.
Motion made by Council Member Pettijohn, supported by Council Member
Richards, to report to MERS the implementation of changes in the
Grandville City Employees Association contract increasing both the
employer and employee defined contribution rates by 1% effective
1/01/2011. The motion was unanimously APPROVED by roll call vote.

Chief
Santo thanked Officers Greco and Clockman for coordinating the Shop
with a Cop event. It was a huge success.
Motion made by Council Member Gelderloos, supported by Council
Member Maas, to approve the Consent Agenda as presented in the best
interest of the City. The motion was unanimously APPROVED by roll
call vote.
CITY MANAGER’S REPORT
Assistant City Manager Butts presented a request from Well House for
authorization of a special liquor license at Rivertown Sports, 2605
Sanford. They will be holding four fund raising event dates in
conjunction with Grand Raggidy Roller Girls. Representatives from
Well House were in attendance. Motion made by Council Member
Gelderloos, supported by Council Member Kauffman, to authorize the
Police Chief to approve the special liquor license request from Well
House for January 22, 2011, February 19, 2011, March 19, 2011, and
April 23, 2011. The motion was unanimously APPROVED by roll call
vote.
Deputy Police Chief Steere presented an Accident Review Policy. The
Policy will be up for adoption at the December 20 meeting.
City
Manager Krombeen explained the information to City Council re:
administration of comparable communities fire departments. With
Chief Veldhouse’s retirement approaching, the information was
compiled to determine if City Council has interest in looking at the
fire department structure.
