PROCEEDINGS OF THE
GRANDVILLE CITY COUNCIL
The Regular Meeting of the Grandville City Council was called to
order by Mayor James Buck on August 11, 2003 at 7:02 p.m.
The City Clerk called the roll. Present were Council Members
Robert DeWitt, Ken Gates, Steve Maas, Carole Pettijohn, Stan
Ponstein, Joe Sierawski, and Mayor James Buck. Absent: None
Also present:
Mike Chesher, DPW Director; Tom Guinther, Treasurer/Finance
Director; Dan Johnson, Assistant City Manager; Randy Kraker, City
Attorney; Mary Meines, City Clerk; and Dennis Santo, Deputy Police
Chief.
Father George Darling, St. Pius X Church, gave the invocation;
and was followed by the Pledge of Allegiance.
Motion by Council Member Maas, and seconded by Council Member
DeWitt, CARRIED, to approve the amended August 11, 2003 agenda as
presented removing the June 30 Treasurer’s Report from the Consent
Agenda.
Motion by Council Member DeWitt, and seconded by Council Member
Gates, CARRIED, to waive the reading of the minutes of the Regular
Meeting of July 28, 2003 and approve as presented.
Motion by Council Member Pettijohn, and seconded by Council
Member Maas, CARRIED unanimously by roll call vote, that bills
totaling $68,580.11 for Fiscal Year 2002-2003 as presented by the
City Manager, be allowed and the Treasurer authorized to pay the
same.
Motion by Council Member DeWitt, and seconded by Council Member
Gates, CARRIED unanimously by roll call vote, that bills totaling
$160,398.58 for Fiscal Year 2003-2004 as presented by the City
Manager, be allowed and the Treasurer authorized to pay the same.
PUBLIC COMMENT

ORDINANCES AND RESOLUTIONS
City Attorney Kraker reviewed the language of proposed Ordinance
No. 204-AZ indicating the wording under sub-section E to read "The
foregoing requirements shall also apply to all uses to be located in
the approximately 21,000 square foot building to be located
generally in the area added to the Grand Pointe PUD by this
amendatory ordinance." Motion by Council Member Maas, and seconded
by Council Member Sierawski, CARRIED, to remove from the table the
proposed amendment to Zoning Ordinance No. 204 of 1994, to Amend
Ordinance No. 204-AR, Approving the Grand Pointe Development PUD.
Motion by Council Member Maas, and seconded by Council Member
Sierawski, CARRIED unanimously by roll call vote, to adopt Ordinance
No. 204-AZ, amendment to Zoning Ordinance No. 204 of 1994, to Amend
Ordinance No. 204-AR, Approving the Grand Pointe Development PUD.
Motion by Council Member Gates, and seconded by Council Member
Maas, CARRIED, to remove from the table proposed Ordinance No.
204-AO.
Motion by Council Member Gates, and seconded by Council Member
Sierawski, CARRIED unanimously by roll call vote, to adopt Ordinance
No. 204-AO, an amendment to Zoning Ordinance No. 204 of 1994, to
Rezone Property from RR, Rural Residential, to RM-3, Moderate
Density Residential.
Motion by Council Member Gates, and seconded by Council Member
Pettijohn, CARRIED, to remove from the table proposed Ordinance No.
259, Amending Chapter 3, Article I, Section 3-6(a) of the Code of
Ordinance of the City of Grandville.
Motion by Council Member Pettijohn, and seconded by Council
Member Gates, CARRIED unanimously by roll call vote, to adopt
Ordinance No. 259 to Amend Chapter 3, Article I, Section 3-6(a) of
the Code of Ordinances of the City of Grandville.
Motion by Council Member Gates, and seconded by Council Member
Maas, CARRIED, to remove from the table proposed Ordinance No. 260,
Amending Chapter 15, Article IV, Division II of the Code of
Ordinances of the City of Grandville.
Motion by Council Member Ponstein, and seconded by Council Member
Maas, CARRIED unanimously by roll call vote, to adopt Ordinance No.
260, an Ordinance to Amend Chapter 15, Article IV, Division II of
the Code of Ordinances of the City of Grandville to Prohibit the
Manufacture, Sale, Possession or Use of a Device or Object Designed
or Used to Defeat or Remove Theft Detection Devices.
Assistant City Manager reviewed the rezoning request for 3040
Prairie and indicated the unanimous recommendation by the Planning
Commission was to rezone the property north of Buck Creek to OS-1,
Office/Service District which is consistent with the Master Plan.
Bill Bowie, McShane & Bowie, was in attendance representing the
applicant, Dr. Northway and stated Dr. Northway intends to keep the
natural vegetation on the portion of the parcel south of Buck Creek.
Fred Sobczak, 3060 Prairie, is opposed to the rezoning because he
feels development of this property could create noise and additional
traffic. Council Member Ponstein asked staff how many buildings,
similar in size to the current building, could be built on this
site. Motion by Council Member Maas, and seconded by Council Member
Sierawski, CARRIED, to introduce a proposed amendment to Zoning
Ordinance No. 204 of 1994, to Rezoning Property at 3040 Prairie (the
area north of Buck Creek) from the Present R-3, Rural Residential
District, to OS-1, Office/Service District.
Motion by Council Member Gates, and seconded by Council Member
Pettijohn, CARRIED, to table the proposed amendment to Zoning
Ordinance 204 of 1994.
CONSENT AGENDA
- Reports: DPW (2nd quarter), EMS/Fire (July), Police
(2nd quarter), Treasurer’s (July 31), WWTP (July)
- Miscellaneous Purchase Orders and Requests
- DPW: Dump/Plow Equipment – Truck & Trailer Specialties, Inc. -
$19,608.00
- Police: (2) Laptop Computers – Hewlett-Packard Co. - $3,956.00
Motion by Council Member Gates, and seconded by Council Member
Maas, CARRIED unanimously by roll call vote, to approve the Consent
Agenda as presented in the best interest of the City.
CITY MANAGER’S REPORT
Motion by Council Member Sierawski, and seconded by Council
Member Pettijohn, CARRIED unanimously by roll call vote, to
authorize the purchase of a printer for the City Clerk’s Department
from CDWG in the amount of $1,728.65 in the best interest of the
City.
COUNCIL MEMBERS COMMENTS
Comments were made regarding sidewalk along Prairie to meet the
Kent Bike Trail system, Kokomo Kafe liquor license transfer
application, memo on West Nile Virus testing, DDA parking
restrictions request, and closing of railroad crossings.
ADJOURNMENT
Motion by Council Member Maas, and seconded by Council Member
DeWitt, CARRIED, to adjourn at 8:05 p.m.
