City Council Minutes

PROCEEDINGS OF THE
GRANDVILLE CITY COUNCIL

Regular session, October 28, 2002, in the Council Chambers at 7:00 p.m.

The meeting was called to order by Mayor James Buck.

The Acting Clerk called the roll. Present were Council Members Ken Gates, Steve Maas, Carole Pettijohn, Stan Ponstein, Joe Sierawski, and Mayor James Buck.

Absent: Council Member DeWitt

Also present:

Mike Chesher, DPW Director; Tom Guinther, Treasurer/Finance Director; Dan Johnson, Assistant City Manager; Ken Krombeen, City Manager; Dennis Santo, Deputy Police Chief; Vern Snyder, Police Chief; Harvey Veldhouse, Fire Chief.

The invocation was given by Rev. Tony Meyer, Ivanrest Chr. Ref. Church; and was followed by the Pledge of Allegiance.

Moved by Council Member Gates, and seconded by Council Member Maas, CARRIED, to approve the October 28, 2002 agenda as presented.

Moved by Council Member Sierawski, and seconded by Council Member Maas, CARRIED, to waive the reading of the minutes of the Regular Meeting of October 14, 2002, and approve as presented.

Moved by Council Member Gates, and seconded by Council Member Pettijohn, CARRIED unanimously by roll call vote, that bills totaling $590,114.39 as presented by the City Manager, be allowed and the Treasurer authorized to pay the same.

PUBLIC COMMENT

59th District Court Magistrate, Dan Zemaitis, addressed the City Council regarding his candidacy for 17th Circuit Court Judge.

Bill Schrader of the Neal Fonger American Legion Post No. 179 informed the City Council of the Veteran’s Day activities with the Grandville Junior Middle School. The Veteran’s Day Ceremony is scheduled for November 11, 2002 at 10:00 a.m. to be held at 28th Street and Wilson Avenue.

ORDINANCES AND RESOLUTIONS

Moved by Council Member Gates, and seconded by Council Member Maas, CARRIED, to remove from the table proposed Ordinance No. 252.

The City Manager indicated Ordinance No. 252 has been revised since the introduction to City Council and City Attorney Kraker reviewed the revisions and recommended adoption. Moved by Council Member Sierawski, and seconded by Council Member Gates, CARRIED unanimously by roll call vote, to adopt the amended Ordinance No. 252, An Ordinance to Regulate Access to and Ongoing Use of the Public Right-of-Way by Telecommunications Providers; to Protect the Public Health, Safety and Welfare and Exercise Reasonable Control of the Public Rights-of-Way in Compliance with Michigan and Applicable Law; and to Ensure that the City Qualifies for Distributions Under Michigan Law by Modifying the Fees Charged to Telecommunications Providers.

Moved by Council Member Pettijohn and seconded by Council Member Maas, CARRIED unanimously by roll call vote, to approve Resolution No. 2562, a Resolution Implementing Telecommunications Ordinance No. 252.

COUNCIL COMMUNICATIONS AND PETITIONS

The City Manager asked for any comments on the Memorandum from Michigan Municipal League Liability Pool relative to some possible Intergovernmental Contract (Bylaw) revisions. He indicated City Council is not required to take action until the end of November. Council Member Maas asked where was the impetus for making the changes. He also questioned what do the bylaws cover because currently bylaws are amended by all of the members and under the new arrangement the Board of Directors would be able to amend the bylaws. City Attorney Kraker commented on the limitation of liability for Pool Directors only and not for the Pool Officers and if the Pool Officers are staff or elected officials. He also asked for clarification of membership termination due to bylaw change; and questioned the broadened use of the Pool surplus.

Fire Chief Veldhouse indicated the fire pumper will be donated to the Thousand Sticks, Kentucky Fire Department.

Moved by Council Member Gates, and seconded by Council Member Maas, CARRIED unanimously by roll call vote, to approve the Consent Agenda as presented, with the purchase in the best interest of the City.

CITY MANAGER’S REPORT

2002-150 Moved by Council Member Gates, and seconded by Council Member Pettijohn, CARRIED, to excuse the absence of Council Member DeWitt.

COUNCIL MEMBERS COMMENTS

Council Member comments were made relative to the "Longest Stream" dedication, Grand Valley Metro Council dinner, Christmas Tree Lighting Ceremony on December 2, 2002 at 7:00 p.m. at the Library Amphitheater.
